The Fair Chance Act is a California law passed in 2018 that directly affects the vast majority of employers with 5 or more employees. Essentially, the Fair Chance Act controls if/how/when employers can even consider someone’s criminal background when making hiring decisions. Violations of the Fair Chance Act can result in serious consequence for employers, and we have learned that most employers do not even know they are breaking the law.
